What does pension provision consist of?

Legal basis

  2. Cumulative, that is, a fixed payment that is accrued monthly. Its amount is determined depending on the amount of accruals from the employer for the entire period of work of the citizen

Thus, the length of the total length of service and its availability have a direct impact on the payment of the pension, but are not the factors that play an important role in determining its size.

The amount of pension accruals today, as before, depends on the citizen’s salary, since the salary portion affects the amount of monthly insurance contributions received by the Pension Fund of the Russian Federation from the enterprise. This means that the higher your official salary, the more money the employer will transfer to your individual account opened with the Pension Fund of the Russian Federation.

If you are an individual entrepreneur, then by law you are required to pay for yourself to the Pension Fund of the Russian Federation in order to be able to receive the required pension from the state in the future.

What working periods can be included in the total length of service?

In order for the state to provide you with an additional payment to your pension payments for 40 years of service, it is absolutely not necessary to work during this time. The legislation establishes rules that state that the following will be taken into account in the full length of service:

  • Conscript service in the RF Armed Forces

When applying for an additional payment for a pension benefit, you should understand that if you have a long work history, there may be other factors that allow for an increase. Thus, one of the main indicators is the size of wages.

The amount of the increase is set at a fixed amount and depends on the financial capabilities of the region.

For example, in St. Petersburg, labor veterans are paid 828 rubles for the title.

The influence of length of service on pension recalculation

Is it possible to recalculate a pension after 40 years of work experience? According to Art. 16 Federal Law No. 400, an additional payment to the insurance pension in a fixed amount is provided for the following categories of citizens:

  • For persons over 80 years of age and disabled people of group 1, the additional payment to the old-age pension is 100% of 3935 rubles. (Part 1, Art. 16 Federal Law No. 400)
  • For disabled people of group 1, the additional payment to the disability pension is equal to 100% of 3935 rubles.

    • 20 or more years of experience in areas equated to the Far North
    • Insurance experience (not less): for men - 25 years, for women - 20 years
  • For minor children under 18 years of age (subject to full-time study at a university - up to 23 years of age), left without both parents or a single mother, the increased surcharge will be 100% of 3,935 rubles.

When can additional pay for length of service be assigned to women and men?

The length of work experience of women and men may influence their ability to receive additional payment to their pension in the following cases:

  • If previously this length of service was not taken into account when assigning payment (for example, due to the lack of supporting documents)
  • If a citizen continues to work as a pensioner
  • If the number of years worked is sufficient to be awarded the title “Veteran of Labor”

In the first two cases, an increase in pension provision is established after a recalculation has been made, and in the second case it is made without a declaration annually from August 1 based on insurance premiums transferred by the policyholder.

If new documents are submitted that affect the amount of the pension, the citizen will need to write an application for recalculation by contacting the territorial office of the Pension Fund of the Russian Federation at the location of his payment file.

Work experience, equal to 35 years for women and 40 years for men, also increases the amount of payment by establishing an allowance for a veteran of labor. This additional payment, as well as the conferment of this title itself, is assigned by the social protection authorities at the citizen’s place of residence.

It is worth noting that this category of citizens is entitled to a monetary increase only if the applicant has already been assigned an old-age pension. Where to contact

Pension benefits are always calculated in the Pension Fund of the Russian Federation. But it is necessary to understand that there may be exceptions here too.

35 years old

  • Official salary figures. Only those amounts of payments that the employee received as “white” payments are taken into account
  • Labor activity. Occurred even after reaching retirement age
  • Pay was equal to the national average. In this case, bonuses and an increased replacement rate are provided

If these conditions are absent, then it is unlikely that you will be able to obtain high bonuses for such length of service.

40 years old

Here it should be understood that for exceeding the length of service, an allowance is given in the amount of 500 to 700 rubles. In this case, for calculations, indicators on wages and the number of increased years of work will be taken.

In this case:

  • 40 years This is experience for women
  • 45 years old Threshold for men

In this case, calculations will be based on a coefficient of 5. It also takes into account what amount of wages a citizen had.

If a person received a high or average income, then additional allowances are provided. And they should also be taken into account when independently calculating pension benefits.

50 years

Citizens of the country who have 50 years of experience or more are provided with maximum benefits by the state. The standard calculation of compensation involves calculation based on additional years of work.

For each such year, one more coefficient should be added to the total number of coefficients.

But in addition to this payment, the state also provides a fixed payment. In 2018 it is 1 thousand 63 rubles.

Important! Military personnel in Russia receive monthly bonuses based on length of service as a percentage of their salary - from 10 to 40 percentage points. At the same time, labor veterans with similar experience receive additional benefits.

But they will have to initially obtain this status for themselves and only after that apply for benefits in the form of free travel, discounts on utility bills, etc.

What is the amount due for excess production?

According to current legislation, for each year of service that is fully worked out and exceeds 30 and 35 years for women and men, 1 percent of the pension is provided. But it is worth considering that the supplement cannot be more than the minimum old-age pension.

Here it is also necessary to take into account how much length of service for excess work is counted:

  • If you work longer, you can count on additional pay even with 20 or more years of experience
  • If the consideration also takes into account the amount of wages, then at least 30 years of experience is required

In this case, the continuity of labor in production or in an organization is not taken into account when calculating. Since this kind of allowance is not used and does not apply in 2018.

What documents are needed to receive an increase?

If you have a total experience of exactly 40 years, you do not need to apply to social security or the Pension Fund of the Russian Federation. But if you have officially worked for more than 40 years, then you need to bring the following documentation:

  • Russian passport
  • Pension certificate
  • SNILS
  • Certificates obtained at places of former work or at an employment center, as well as from archives and medical institutions

How are pension payments calculated for labor veterans?

For labor veterans, the law provides for completely different conditions for pension payments.

Labor veterans include citizens who:

  • Worked as a minor during the Second World War, with a total experience of more than 35 years
  • Earned the length of service necessary to enter a well-deserved retirement, and during their service they were awarded medals, titles, orders

In order to be recognized as a labor veteran, you will need to visit the social security office at your place of registration in order to obtain the appropriate certificate.

Changes in the retirement age for people with more than 40 years of service from January 1, 2019

In June 2018, Dmitry Medvedev announced a new pension reform to raise the retirement age. From January 1, 2019, the retirement age will begin to increase in stages “plus one year every other year.” As a result of the reform, which will take 10 years for men and 16 years for women, the retirement age for women will increase to 63 years, and for men to 65 years. Premium coefficients for long experience

Federal Law No. 400 “On Insurance Pensions,” adopted in December 2013, established new procedures for the formation of insurance pension payments in Russia. During the discussion and drafting of the law, many ideas were proposed regarding what should form the basis of the new pension system. The choice was made in favor of the so-called pension points - a kind of universal coefficients that simultaneously provided information about:

  • The amount of a citizen’s pension contributions per year, taking into account his official salary
  • Work experience

When developing the law, there was a plan to introduce bonus points for long work experience (from 30 years for women to 35-40 years for men). The so-called pension supplement for 40 years of service did not appear in the final version of the law. Instead, bonus coefficients were introduced for deferring retirement for a period of 1 to 10 years.

Legislators expressed the idea that such replacement of some bonus incentives with others is in fact identical. Without applying for a pension and continuing to work, a citizen actually accumulates additional work experience and receives coefficients for this to increase the payment up to 2 times.

Thus, the initiative to introduce incentives for persons with extensive insurance experience has not found a place in modern legislation. The procedure for calculating payments for persons who have worked for 40 years is no different from a similar procedure for all other citizens.

Awarding the title “Veteran of Labor”

The provisions on the status of “Labor Veteran” are reflected in Federal Law No. 5 “On Veterans”.

This status can be obtained by:

  • Persons who began working during the Second World War as minors with 40 years of experience for men and 35 for women
  • Persons who have state, government, departmental awards and titles with 15 years of experience in a certain field and a total experience of 25 years for men and 20 for women

Despite the fact that the provisions on labor veterans are spelled out in federal legislation, the status itself has been transferred to the rank of regional since 2005. This means that the subjects of the Federation have become empowered to independently determine the requirements for citizens to obtain this status and assign it.

Most regions have adopted the above requirements of the federal legislative act as a standard. These include Moscow, St. Petersburg, Krasnodar Territory.

Some entities have put forward their own provisions regarding the assignment of status:

  • In the Republic of Sakha (Yakutia) the title is awarded to:
    • Persons with republican awards and 25 years of experience for men and 20 women, which was developed in the region;
    • Men with insurance experience of 40 years and women of 35 years, of which 25 (20) years were worked in Yakutia, and 15 in a certain field of activity;
    • Women who gave birth to or raised 4 or more children under 8 years of age, subject to 20 years of experience in the territory of the subject.
  • In the Kostroma region in June of this year, the requirements for obtaining the title of labor veteran were relaxed. Now it is assigned to men with 40 years of experience and women with 35 years of experience, of which 25 (23) years were worked in the region. The provision that required the presence of a Certificate of Merit of any rank was eliminated.
  • The Sverdlovsk region places the priority on whether the applicant has any award. The regional law lists titles and awards that allow citizens of the region to apply for the status of labor veteran:
    • Men can receive the title after completing 35-40 years of experience
    • Women are required to have 30 years of experience. Mothers of many children with the Order of Maternal Valor can have experience from 10 to 20 years, depending on the degree of award

Acceptance of documents, making a decision and assigning a title is under the jurisdiction of regional bodies for social work with the population.

Additional payment to pension for 40 years of service

The current additional payments to pensioners for 40 years of service are reduced to MDV - a monthly cash payment. Its amount is set by local authorities and paid towards the pension.

As can be seen from the table, financial assistance to labor veterans in Russia as a whole is very symbolic. These payments are increased annually due to their indexation by the percentage of established inflation, but a significant increase in such payments is apparently not expected. This is partly due to the fact that labor veterans are recipients of a fairly significant package of benefits.

Benefits for labor veterans

Federal law shifts the provision of a preferential package to regional authorities as a responsibility. However, the law contains a list of benefits for persons with veteran status. This:

  • Some regions have established local benefits for land and transport taxes.

Calculation of pensions with long service

To understand how a pension is calculated in conditions of long service, it is necessary to understand the general scheme by which the insurance payment is calculated.

Since 2015, this formula has been as follows:

P = (B * SB) + FV

  • P – the required pension amount
  • B – pension points. Accrued annually, the amount depends on the size of pension contributions
  • SB – the cost of one point at the time of calculation. From January 1, 2018, the cost of one pension point is 81.49 rubles
  • FV – fixed payment towards pension. The fixed payment amount in 2018 is 4982.9 rubles

The formula does not contain such a thing as an increase for pensioners for 40 years of service. Experience in it is reflected indirectly in the concept of points: the longer a citizen works, the more points he will receive. But the number of points largely depends on the salary.

Thus, a pension for 40 years of service is calculated according to the same scheme with payment for a shorter period of work. The new pension system, although it puts forward certain requirements for the minimum length of service to receive a pension (9 years in 2018), does not contain any mechanisms in relation to citizens whose work experience has reached 35-40 years.

An important point is the question of how pensions were calculated before 2015.

Important! Citizens who have now completed significant work experience began their working career back in the 70s of the last century. Since that time, several systems for calculating pension benefits have been in operation in the country.

Let's look at this issue in detail using the example of calculating the pension of a particular citizen.

An example of calculating a pension in 2018

When calculating your pension, you will need to take two periods into account:

  • Until 2015, when new pension legislation based on a point system came into force
  • After 2015

In order for the payment to be processed in the current or next year, all pension savings to the Pension Fund that were transferred before 2015 will undergo a conversion process. This means that information about the length of service, the amount of deductions and the citizen’s salary will be transferred to a modern point system.

Let's look at how conversion is carried out for the period up to 2015. An important point is the concept of “pension capital” - these are funds collected before the introduction of new legislation that are accumulated in a person’s pension account. To calculate it we use the formula:

PC = FFP * 12 * C * 16%,

  • PC – pension capital by January 2015;
  • SWP – average earnings during the calculation period;
  • 12 – number of months per year;
  • C – length of service developed before 2015;
  • 16% is the percentage of earnings that was contributed to the pension.

Let's take as an example Ivan Volkov, whose career began in 1977 at the age of 20. In November 2017, the man will celebrate his 60th birthday and plans to obtain the status of a labor veteran and a pension.

We calculate the man’s pension capital collected by 2015:

17000 * 12 * 40 * 16% = 1,305,600 rubles

As the average salary, we took the modern salary of a man in the amount of 17,000 rubles. For more accurate calculations, it is necessary to make rather difficult conversions of previous amounts into current ones. A certificate about the state of your pension account at a certain time can also be obtained from the Pension Fund. To do this, you need an application, passport and SNILS.

The following formula allows us to convert this figure into the required points:
