From this day on, all services of the enterprise can plan vacation schedules, calculations of working hours, and event plans for any period by month or quarter. But the standard working time is a five-day week: working days from Monday to Friday and two days off. The length of the working day varies from 8 hours (normal) to 4.8 hours (shortened day). Accordingly, the working week can be 40, 36 and 24 hours.
The amount of working time is determined on the basis of the Procedure, which is approved by order of the Ministry of Health and Social Development. The formula by which the rate is calculated is given in the above document. It is quite simple: the number of working hours in a week, for example, 40, divided by 5, then multiply the resulting number by the number of days of work that are in the month, and finally, subtract the hours of shortened working days. But today accounting and personnel can forget even about these simple calculations. After all, the 2018 production calendar already contains the necessary numbers, comments and tips.

  • The first month of the year begins with the holidays that all Russians are looking forward to; they will last from December 30, 2017 to January 8, 2018. They also include the Nativity of Christ, the 7th. In January 2018, there were 17 work shifts, six weekends and eight holidays.

  • In March, including holidays and weekends, there are 31 days. Twenty working days, ten days off and one holiday non-working day.

Here, the Government of the Russian Federation has moved Saturday, January 6, to Friday, March 9. As a result, it turned out to be a short spring break, because along with Saturday and Sunday there were four days of rest: March 8, 9, 10, and 11.

Second quarter


The next period is April, May, June. In it, government transfers affected all three months.

  • April has 30 days, of which 21 are working days, 9 days off. The 28th day of the month - the pre-holiday day, according to part one of Article 95 of the Labor Code of the Russian Federation, is shortened by one hour. It concerns the postponement - this Saturday has been moved to Monday, April 30th. This created a continuous four-day rest period. The first holidays in May begin on April 29 and will last until May 2 inclusive.
  • In total, May contains twenty working days, 9 weekends and two holidays - Victory Day and the Spring and Labor Festival. The second holiday of May falls in the middle of the working week. It was not affected by the transfers, therefore May 8 was shortened by one hour according to the current labor legislation, and May 9 (Wednesday) is a non-working holiday.
  • The June work schedule in 2018 consists of 20 days of work, nine days off and Russia Day. This holiday, June 12, falls on Tuesday. Government Decree “On the postponement of weekends” dated June 20, 2017. Saturday, June 9 moves to the nearest Monday, June 11. Russians have a working Saturday, and then a period of continuous rest includes June 10, 11, 12.

Third quarter


In the third quarter of '18 - July, August and September. There are no holidays during these months, but the period is significant from the point of view of accounting reporting and the work of the labor protection service.

  • In July, before the 27th, the accounting department submits an important report on the profit of the enterprise and organization and pays the tax of the same name.
  • Before August 1, the organizational structures responsible for occupational safety submit to the Social Insurance Fund an occupational safety action plan to reimburse part of the expenses that have already been made or are planned to be made before the end of the year.

Fourth quarter


The last quarter, consisting of October, November and December, includes one holiday, November 4, National Unity Day.

  • October, as determined by the production calendar for 2018 with holidays, becomes the leader in the number of working days: there are 23 of them and eight days off.
  • November consists of 21 working days and 9 non-working days, including a public holiday. It falls on Sunday, which means, according to Article 112 of the Labor Code, it is postponed to a working day, Monday, November 5. The first weekend of November becomes extended - from Saturday, November 3rd to Monday, November 5th. For those enterprises that operate a six-day work week, Saturday will be a shortened pre-holiday day.
  • In December, on the contrary, one of the Saturdays will be shortened, but working - the Government moved December 29 to December 31, ensuring the continuity of the rest period for Russians during the New Year holidays.

Based on the draft resolution of the Russian Government and in particular Rosmintruda, the schedule of weekends and working dates for the upcoming New Year period will be as follows: from December 30 to January 8 inclusive — the New Year holidays will be held, so the duration of the New Year holidays this year will be 10 days, which is 1 day more than in 2017.

Thus, in January 2018, from the 31st calendar day, there will be 17 working days, in turn, there will be 14 days off and holidays this month.

Postponement of holidays in January

For a more rational use of time, the highest authorities made the following decision: due to the fact that January 6 falls on a Saturday (and by law this day refers to the New Year holidays and is considered a non-working day), it is postponed to March 9. The transfer of weekends and holidays described above will not be the only one for January 2018. Due to the fact that January 7, the Nativity of Christ, is classified as and falls on a calendar day off - Sunday, there will be another shift in the production calendar. In this case, the day off on January 7th is moved to May 2nd.

The question may arise: how are such movements of holiday dates in the production calendar legalized? The answer can be found by referring to the legislation of the Russian Federation, which states that if a public holiday falls on a calendar weekend (that is, Saturday or Sunday), it is automatically transferred to the nearest Monday or other convenient date. This date is discussed at the highest level and finally set by adopting the relevant act and making it public.

How the weekend in January 2019 was postponed

Article 112 of the Labor Code of the Russian Federation provides that the transfer of days off is carried out for the purpose of rational planning of working time in organizations and taking into account the interests of various categories of citizens of the Russian Federation in creating conditions for proper rest.

For these purposes, Decree of the Government of the Russian Federation dated October 1, 2018 No. 1163 “On the transfer of weekends in 2019” provides for the following shift of weekends:

  • from Saturday 5 January to Thursday 2 May;
  • from Sunday 6 January to Friday 3 May;
  • from Saturday 23 February to Friday 10 May.

Work on weekends and non-working holidays in January

According to the law, work on weekends and non-working holidays is prohibited (Article 113 of the Labor Code of the Russian Federation). However, there are exceptions to this rule.

For example, it is allowed to involve an employee in work on a weekend/non-working holiday if there is a need to perform unforeseen work, on the urgent completion of which the further normal functioning of the organization depends.

In this case, the employee can be involved only with his written consent.

Please note that sometimes hiring an employee on weekends/non-working holidays (including in January 2019) is possible without obtaining consent from him.

For example, such situations include the involvement of an employee to prevent a catastrophe/industrial accident or eliminate the consequences of a catastrophe/industrial accident/natural disaster (Article 113 of the Labor Code of the Russian Federation).

How to pay for work on weekends and non-working holidays in January 2019

Work on weekends, as well as non-working holidays, is subject to payment at least double (Article 153 of the Labor Code of the Russian Federation).

The exact amounts of remuneration for work on weekends/non-working holidays (including January 2019) can be specified in a collective agreement, local regulation or employment contract.

In this case, work on a weekend/non-working holiday is paid at a single rate, and the day of rest chosen by the employee is not paid (Article 153 of the Labor Code of the Russian Federation).

Working hours standards in 2019

According to the Russian production calendar, in January 2019 there are 17 working days and 14 weekends and holidays in the country.

Standard working hours:

  • at 36 hours – 122.4 hours (17 x 7.2);

Clarifications on working time standards

Art. Art. 91 and 92 of the Labor Code of the Russian Federation standardize the working hours for certain categories of workers:

  • generally accepted - 40-hour work week;
  • for company employees under 16 years old - up to 24 hours/week;
  • from 16 to 18 years old - up to 35 hours/week;
  • for disabled people of 1st and 2nd degree - up to 35 hours/week;
  • for workers in hazardous and heavy industries - up to 36 hours/week.

There are also special regimes for students and part-time workers. According to the Labor Code of the Russian Federation and Order of the Ministry of Health and Social Development No. 588n dated August 13, 2009, any company by collective agreement can establish a different working time, which cannot exceed the maximum established by the Labor Code.

Important!

  • In organizations with summarized time recording for periods equal to a month or a year or another period of time, their daily, weekly and monthly norms are calculated based on the work period norms established in the Labor Code of the Russian Federation.
  • When accounting for overtime in aggregate, work on holidays and weekends included in this period will not be recognized. This is considered to be overtime processing.
  • So, if the period is the 3rd quarter of 2018, then the norm will be 520 hours. This means that overtime is recognized as time worked from 521 hours.
  • It is worth noting that there will be no violation of the Labor Code of the Russian Federation in this case, since payment for work on holidays/weekends will have to be made in double amount.

But in any case, the daily rate is calculated from the standard assumption about the length of the week - 5/2. Even if the organization is on a 6-day schedule. The norm is calculated by dividing the weekly time by 5:

  • 40 hours / 5 = 8 hours
  • 36h. / 5 = 7.2 hours.
  • 24 hours / 5 = 4.8 hours
  • And so on.

The standard version of the production calendar takes into account all working time standards provided for by the Labor Code of the Russian Federation. The accountant can only find out the category of the employee in order to calculate his salary.

The monthly norm (MN) is calculated based on the daily norm (DN):

DN* number of working days in a month = MN,

if a reduction in working hours is expected in a month due to a subsequent holiday, then the number of hours of reduction is subtracted from the MT.

For example, the monthly working hours in November 2018 with a 5-day (40-hour) week:

(40 hours / 5)* 21 = 8*21 = 168 hours.

The annual working hours are calculated using the formula:

DN* number of working days in a year - “decreasing” hours.

Holidays and shortened days according to the calendar

So, what holidays await us in 2018 and what days will be shortened before these holidays will be described in detail below.

Holidays

Thus, the list of official non-working holidays at the federal level is given in Article 112 of the Labor Code.

But Russia is a multi-religious country, and holidays among its citizens may differ. Therefore, Art. 6 of the Labor Code of the Russian Federation and Article 4 of the Federal Law “On Freedom of Conscience and Religious Associations” stipulate that the authorities of the constituent entities of the Russian Federation can declare other days as holidays, taking into account local traditions and beliefs. So, for example, in the Republic of Tatarstan these are: June 25, August 30, September 1. The subject's holidays are included in the subject's PC and affect the standard working hours.

Holiday-day off

Part 2 of Article 112 states: if a holiday falls on a non-working Saturday or Sunday, then in exchange for this day off, another day of rest is provided - the next working day. This rule is valid for all times except the New Year holidays. So, November 4, 2018, National Unity Day, is Sunday, so the weekend will be November 3, 4 and 5.

In accordance with Article 113, it is prohibited to involve employees in work on holidays. It's easy to remember this when using a PC: dates are highlighted and when you hover over them, pop-up tips - warnings - appear.

Shortening the working day before a holiday

In addition to holidays, the calendar also marks pre-holiday days with a note about the obligatory reduction of the working day by one hour (according to Article 95 of the Labor Code). The “smart” PC will also take into account the days when holidays are moved from a weekend to a weekday.

Transfers of holidays in 2018

There are many holidays in the Russian Federation and sometimes these days are not very convenient for citizens. In order to optimize rest time, the legislator, in the same Article 6 of the Labor Code of the Russian Federation, provided for the possibility of transferring holidays to other days. It is formalized by an annual Government Decree. No more than 2 days can be transferred from the New Year holidays, which has been done for several years in a row.

In 2018, transfers will be as follows:

  • From Saturday January 6th to Friday March 9th
  • From Sunday January 7th to Wednesday May 2nd
  • From Saturday 28 April to Monday 30 April
  • From Saturday 9 June to Monday 11 June
  • From Saturday 29 December to Monday 31 December

All transfers became officially known in the fall of 2017, but nevertheless, adjustments are still possible, keep this in mind.

What data can be seen on the production calendar

PC is an unofficial document; its introduction and use is not regulated by law. However, in essence, PC is a reflection of some articles of laws on a regular calendar.

In addition to, in fact, the usual calendar with notes on working, weekends and holidays (official and national) days, the PC includes:

  • tables with calculated working/non-working time standards by month and quarter,
  • numerical information about the number of working hours and days off in each reporting period (from month to year),
  • information about postponing holidays and reducing the length of the working day before them.

Who needs a calendar?

The working population of the Russian Federation almost always turns to PCs when planning a vacation.

Accountants use a PC to calculate disability payments, vacation pay, and salaries. Full accrual occurs when working hours are met for the month. Proportional accrual will be made in the case where the employee did not work for the entire month.

In “gray” companies, PCs are used by personnel officers, who are usually responsible for calculating part of the salary “in envelopes”. They also draw up work and shift schedules based on it, and count the number of vacation days to which the employee is entitled.

The rest of the population learns from the PC about professional and other holidays and weekends; uses other information.
